FSSAI License for Health Drinks

FSSAI’s Role:

The Food Safety and Standards Authority of India (FSSAI) has taken a number of initiatives to remove the terms “health” and “energy” from these market concoctions. These drinks must now include a safety notice on their labels so that consumers are aware of what they are drinking. Furthermore, the label must state that these beverages are not suggested for use by nursing or pregnant women, children, or caffeine-sensitive individuals.” The drinks must also be eaten in no more than two cans per day, according to the label. The Agency is attempting to keep a lid on the overconsumption of these drinks, which can lead to major medical problems in many people, by establishing these standards.

Following a number of incidents in which customers were harmed as a result of ingesting these health beverages, the Food Safety and Standards Authority of India (FSSAI) decided to tighten the standards in this sector. Many studies have shown that drinking coffee with a high caffeine concentration causes serious medical problems.

According to the most recent criteria indicated in the draught, there is no need to disclose nutrition information, such as nutritive and vitamin claims to be included on the label.

Steps were taken by FSSAI

The Food Safety and Standards Authority of India revoked the products’ NOCs and ordered them to be recalled since they were deemed unsafe. The Authority urged the manufacturers of one of the popular health drinks, “Restless Energy Drink,” to remove it from the market immediately in an order dated June 11th, 2015. This is due to the fact that it was discovered to be extremely dangerous to consume. The FSSAI awarded a one-year NOC (No Objection Certificate) for this drink on August 13.

The FSSAI’s scientific panel afterwards discovered an unreasonable Ginseng and Caffeine combination having an opposite effect on the human body on January 21st, 2014. Following the findings of the scientific panel, FSSAI recommended that the product be considered dangerous and issued a recall order. The corporation has been told to stop making, selling, and distributing this health drink on the market. M/s Pushpam Food & Beverages manufactured the product. In the past, the company has applied for approval of additional health and energy drinks. Cloud 9 Red Grapes Energy Drinks, Cloud 9 Pomegranate Energy Drink, Cloud 9 Premium Drink, and Cloud 9 Wild Berry Energy Drink were among the drinks. After a thorough review by the Scientific Panel on Functional Foods, Dietetic Products, Nutraceuticals, and Other Similar Products, the NOC for these drinks was also revoked. A similar illogical mix of Ginseng and Caffeine in the health drinks was the cause of the withdrawal. In November of 2014, the NOC was revoked.

Tzinga Energy Drink was another famous health drink that was pulled by the FSSAI. Tropical Trip, Lemon and Mint, and Mango and Strawberry were among the flavours available. Hector Beverages Pvt Ltd created these beverages. The company was requested to take the drink off the shelves. The following were the grounds for this decision:

The reasons behind this decision were as follows:

  • Use of potentially hazardous chemicals, such as ginseng and caffeine in combination
  • There was a difference in the quantity and composition of the additives and ingredients used in the product/serving size between the original application shared with the authority for product approval and the one later provided with FSSAI when the authority requested clarification.
  • The producer was unable to provide the supplied ingredients.
  • Global agencies such as the US Food and Drug Administration, Codex, FSANZ, the European Union, and the World Health Organization did not give any data on safety evaluations.

The corporation also came up with two different flavours of these drinks, Apple and Mango, without first getting FSSAI permission. It is illegal to introduce a product into the market without first obtaining regulatory permission. As a result, it was deemed illegal. Even if the product’s constituents are marginally different from the parent product, separate product approval is required.
